What Changed: The March 2025 and January 2026 Documentation Shifts

If you're making Aliyah from the United States in 2026, the paperwork isn't what it was two years ago. March 2025 marked significant changes to Aliyah requirements, including stricter verification of Jewish ancestry documentation and enhanced scrutiny for those with distant Jewish ancestry. Then, starting January 1, 2026, significant new requirements took effect.

The shift signals a strategic divide for American applicants: arrive by end of 2025 for financial privacy, or arrive in 2026 for enhanced Israeli income tax benefits but with full global disclosure requirements. This is no minor distinction. New rules now tie benefits directly to actual residency and full transparency of foreign assets.

Core Document Checklist: What You Still Need (The Basics Haven't Changed)

Despite stricter verification, the foundational documents remain consistent. Birth certificate, marriage/divorce certificates, proof of Jewish ancestry or conversion, health statements, travel records to Israel, and possibly a criminal background check are all still required.

Start your timeline early. Begin your paperwork 8-10 months before your estimated Aliyah date by completing the Aliyah application on the nbn.org.il website. Nefesh B'Nefesh handles Aliyah from the USA and Canada.

How much time should I allow for document gathering in 2026?

10-12 months before: Research eligibility, contact Jewish Agency, begin financial planning; 8-10 months before: Submit online application, order birth certificates and civil documents; 6-8 months before: Obtain rabbi's letter, begin apostille process, gather passport photos; 4-6 months before: Order background check (valid 6 months), upload all documents to portal; 3-4 months before: Complete Jewish Agency interview, receive approval; 1-2 months before: Apply for Aliyah visa, book flight, arrange shipping.

The Proof of Judaism: Where Standards Tightened Most

Proof of Judaism requires a rabbi's letter on official letterhead (within past year), ink signature required, stating that you are Jewish and born to a Jewish mother, with the rabbi's explanation of how they know you, official synagogue letterhead with name, address, and phone number, rabbi's name and title on letterhead, and written within the past year.

This is where the March 2025 changes bite hardest. Stricter verification of Jewish ancestry documentation and enhanced scrutiny for those with distant Jewish ancestry are now applied. If you're eligible through a Jewish father or grandfather rather than a Jewish mother, be prepared for additional requests.

What if I can't get a rabbi's letter for proof of Judaism?

If you are Jewish through your father or grandfather, provide a letter from a recognized Rabbi from a synagogue or temple associated with a rabbinical organization in North America, stating that you were born to a Jewish father or grandfather as relevant, listing their names, and you may also be required, by the Jewish Agency, to provide a copy of your father's Birth Certificate, your parents' Marriage Certificate, and/or your grandparent's Marriage Certificate.

Civil Documents and Apostilles: The Authentication Requirement

Birth certificate must be original long-form with both parents' names listed and must have apostille. Since January 1st, 2019 authentication is required by the State of Israel on all official documents as part of the Aliyah process.

An apostille is not a notarization—it's international certification. Apostilles are issued by the state that issued the document and usually cannot be acquired outside of that state and it is typically an additional page attached to the original document to authenticate the signature of the clerk which appears on the original document.

Document TypeApostille Required?Special Notes for Americans 2026
Birth CertificateYesLong-form only, issued by county vital records. NYC requires letter of exemplification.
Marriage/Divorce/Death CertificateYesCivil document only; religious marriage not sufficient alone.
Criminal Background Check (FBI)YesValid for 6 months only. Must be obtained from FBI, not state police.
PassportNoCopy required; original kept for visa appointment.
Marital Status AffidavitYes for those age 18+New requirement; must be notarized and apostilled. Valid 6 months from authentication.
Rabbi's Letter (Proof of Judaism)NoOriginal ink signature required; no digital signatures accepted.

The Criminal Background Check: A Timeline Surprise

Criminal Background Check is required from every country lived in for 1+ year since age 14, valid for 6 months only, and must have apostille. This is a common reason for delays.

US applicants can apply for an FBI background check through Nefesh B'Nefesh, including fingerprinting and apostille, by emailing them, and this service is offered for a fee of 880 NIS for Olim to cover the cost. Order this at the 4-6 month mark—don't wait. A six-month validity window means you'll need to time it precisely with your flight.

What if my background check expires before my flight date?

You'll need a new one. The six-month validity clock starts from the apostille date, not the FBI issue date. Plan to order your background check 5-6 months before your anticipated Aliyah date, not earlier. If your flight date shifts, you may need to reorder.

The Health Declaration: New Scrutiny

Health Declaration is required form for each family member, and parents complete for minors under 18. Unlike a doctor's form, this form is for you to fill out yourselves; it is not meant to be completed by your physician.

Be honest and complete. The March 2025 changes included expanded health-condition reviews. Certain health conditions may require additional review.

Entry/Exit Records and the 7-Year Window

Entry/Exit Form: List of all Israel entries/exits for past 7 years is required for ages 17+. For all family members age 17 and above who are making Aliyah, submit a detailed list of all entries and exits from Israel for the seven years prior to your anticipated Aliyah date, and if you have never been to Israel, or haven't visited Israel in the seven years prior to your Aliyah, you must still sign and submit this form, with an explanatory note.

If you've visited Israel on past tourist visas, track those visits carefully. The timeline now extends seven years, not five.

The 2026 Financial Disclosure Change: Full Transparency Now

Here's the most significant 2026 shift for American olim earning foreign income: Starting between November 2025 and December 2026, new Law provides temporary tax benefits for certain new immigrants and introduces specific incentives for American Olim, including a five-year exemption from Israeli National Insurance (Bituach Leumi) on certain income for those who continue paying US Social Security or self-employment tax.

But this comes with a cost. Those arriving in 2026 must disclose global assets. Those who arrived by December 31, 2025 retain financial privacy. This creates a strategic decision for potential immigrants: arrive by end of 2025 for financial privacy, or arrive in 2026 for enhanced Israeli income tax benefits but with full global disclosure requirements.
